INTRODUCTION. As part of its efforts to support the development of micro and small enterprises, the "Foundation, Desafío Levantemos Chile". (hereinafter the "Foundation"), has developed and is the owner and administrator of the electronic platform "Yo elijo local" ("I choose local"). which is housed in the domain www.desafiolevantemoschile.cl (hereinafter the "Site"), whose purpose is to serve as a showcase for entrepreneurs (hereinafter the "Entrepreneurs") to promote their businesses.
Thus, "I choose local" is only an exhibition platform, but it is not a transactional platform, that is, it does not allow by itself to make purchases, nor the payment of the products or services sold or rendered by the Entrepreneurs, operations that are carried out directly between buyers and sellers through the means and channels that the Entrepreneurs have or agree with the buyers, without responsibility for the Foundation.
TCGU. The present document contains the general terms and conditions (hereinafter "GTCU"), applicable to the use of said platform by the Entrepreneurs and potential buyers. The GTCU shall apply especially to the acts and actions related to the publication and dissemination of the Entrepreneurs' products and services on the platform.
The GCUs are binding and mandatory and must be accepted by the Entrepreneurs prior to their registration on the Site. In case the GCUs are not accepted, the publication of the Entrepreneurs' businesses and products through the Site will be prohibited.
It shall be understood that potential buyers, by the mere fact of accessing the Site, accept the GTU.
QUALIFICATION. The Foundation is empowered to create an efficiency rating system in the delivery of goods or services offered, for which it will use the information it collects according to the available information channels. Based on such information, the Foundation reserves the right to admit those who comply with such rules prior to their incorporation and during their stay on the platform, as well as reserves the right to exclude them in the following cases, being the following non-exhaustive list: non-compliance with the terms of the agreed sale, misuse of the platform, promotion of prohibited items and in general those who by any means do not respect the current regulations, but none of this will imply responsibility for the Foundation, against the breach of the Entrepreneur, being only a reflection of the behavior that this has been presented to date.
RESPONSIBILITY.The Undertakers and buyers or potential buyers acknowledge and agree that the terms of price and delivery of the goods and services of the Undertakers are those freely determined between them and that the Undertaker shall be solely responsible for any kind of quality and price, of delivery conditions and dates, reimbursement, restitution, warranty, direct or indirect damages, loss of profits, consequential damages, damage to image, injuries, illnesses suffered by the buyers, directly or indirectly caused in whole or in part by the Entrepreneur or by the goods and services of the latter. Likewise, it shall be the sole responsibility of the buyer to pay the price and any other obligation inherent to such quality.
And, consequently, Entrepreneurs and buyers or potential buyers, acknowledge and accept that the Foundation has no responsibility whatsoever in these matters.
Likewise, Entrepreneurs and buyers or potential buyers recognize and acknowledge that the computer platform provided by the Foundation is not infallible, and therefore, circumstances beyond its control may occur that imply that the Site is not operational for a certain period of time. In such cases, the Foundation will try to reestablish the Site and the computer system as quickly as possible, without being held responsible for this.
The Foundation is not responsible for viruses or other elements that affect the Site and that may cause alterations in the computer system of Entrepreneurs and buyers or potential buyers.
INTELLECTUAL PROPERTY.The content, organization, graphics, design, layout, compilation and other aspects of the Site belong to the Foundation and are protected by Intellectual Property laws. Copying, redistribution, use or publication, in whole or in part, is prohibited by law.
MODIFICATION OF THE GENERAL TERMS AND CONDITIONS OF USE.
In this act, the Foundation reserves the right to modify at any time and unilaterally the GCUG, making such modification public on the Site, which will be effective from the date of its publication on the Site.
IMPORTANT
Information for Entrepreneurs
-I authorize Desafío Levantemos Chile to contact me for purposes related to activities that are related to the platform and/or my undertaking.
-It is the sole responsibility of the entrepreneur to have the corresponding sanitary permits and sanitary resolutions, otherwise Desafío Levantemos Chile reserves the right of publication as appropriate.
-It is not necessary to have my venture formalized to apply to the platform.
-If you do not meet the minimum mandatory requirements requested at the time of application, your business will not be published.
- It is essential to include a profile picture of the entrepreneur or his/her logo, otherwise you will not be complying with the requirements, therefore, you will not be published.
-It is very important that in the social networks field you insert the link or hyperlink of your network. Otherwise, you will be excluded from the application.
-Undue conduct, failure to deliver products, among others (illicit, illegal, racist, terrorism, conduct against human rights). They will be evaluated by the Foundation, which, depending on the seriousness of the incident, has the absolute right to expel the entrepreneur from the platform.
- The user guarantees the authenticity and timeliness of all data provided and shall be solely responsible for any false or inaccurate statements made.
- Any type of misleading advertising, where they seek personal gain, will result in expulsion from the Platform.
Platform
-The Platform lends itself only to generate greater visualization of the ventures; those who seek other purposes will be excluded from the application.
- Desafío Levantemos Chile has the right to modify, at any time and without prior notice, the configuration of the Website (Contents or services).
- Any type of plagiarism or use of personal data of another person will lead to immediate expulsion and application of Law N 19.628 (Personal Data Protection Law). *The Foundation excludes itself from any kind of responsibility.
- The provision of the service of the Platform and other services of the website, in principle will have indefinite duration, however, Desafío Levantemos Chile is authorized to terminate or suspend the provision of the service of the Platform at any time.
The publication and selection criteria are the responsibility of Desafío Levantemos Chile and the content is the responsibility of those who issue them, and Banco de Chile is not responsible for them. Please inquire about the state guarantee of deposits at your bank or at www.cmfchile.cl.
